Can a NYC Landlord Require You to Use a Specific Guarantor Company?
You found an apartment. Your application looks good. Then the broker tells you:
“This building only accepts a specific third party guarantor company.”
Do you actually have to use that company?
Usually, a New York City landlord can decide which institutional guarantor companies it is willing to accept. But “we use this company” does not necessarily mean you have no other options.
Before paying a guarantor fee, it is worth asking one simple question:
“Would the landlord accept another institutional guarantor that provides comparable coverage?”
The answer may save you money and give you access to a guarantor with better terms.
Can a NYC landlord choose which guarantor companies it accepts?
Generally, yes.
An institutional guarantor is not just another document in your rental application. The guaranty is designed to protect the landlord if you fail to meet certain lease obligations.
That means the landlord has a legitimate interest in reviewing things such as:
who stands behind the guaranty;
how much rent is covered;
how long coverage lasts;
what events are covered;
exclusions and conditions;
how claims are submitted; and
how quickly valid claims are paid.
There does not appear to be a general New York City law requiring a landlord to accept every institutional guarantor company a renter chooses.
A landlord may therefore maintain a list of approved guarantors or decide that it only accepts certain providers.
But there is an important difference between “these are the guarantors we already work with” and “we will refuse every other guarantor.”
If you prefer another provider, ask.
“We use this guarantor” may not mean “you must use this guarantor”
NYC rentals move quickly, and brokers tend to follow whatever process a building already uses.
If a management company has worked with the same institutional guarantor for years, a broker may simply tell every renter to apply there.
That does not necessarily mean ownership has evaluated every alternative and rejected them.
Ask the broker or property manager:
“Is that the only guarantor the landlord will accept, or is it simply the preferred provider?”
If alternatives are possible, ask whether the landlord will review the guaranty terms before you purchase anything.
This is especially worthwhile because the cost of institutional guarantor services can vary significantly based on the applicant and provider.

Claims
How complicated is the claims process?
What documents are required?
How quickly are approved claims paid?
A lower-priced guarantor is not necessarily more attractive to a landlord if collecting on the guaranty is difficult.
Experience
Large management companies often standardize their rental process across hundreds or thousands of apartments.
Once a guarantor has been approved internally, using the same provider repeatedly is easier for leasing teams.
