Here's the scenario that keeps some owners from accepting a rent guarantee. The tenant buys the bond, signs the lease, gets the keys. Two weeks later they call the guarantor and cancel. You find out in month five, when the rent stops and nobody is behind it.
With PandaGuarantee, that can't happen. Once the lease is signed, the tenant can't cancel the bond. It stays in place for the lease term, and the only person who can file a claim on it is you.
Why can't the tenant cancel?
Because the bond isn't for the tenant. A surety bond has three parties:
- The principal is the tenant. They owe the rent, and they pay the one-time premium.
- The obligee is you, the landlord. The promise runs to you.
- The surety is the bond issuer, which pays you if the tenant doesn't.
The tenant pays for the bond, but they aren't the one it protects. If the principal could cancel at will, the promise to you would last only as long as the tenant felt like keeping it. That would make it useless on exactly the day you need it.
Renters insurance works the other way. It protects the tenant's belongings, so the tenant can usually cancel it. We break down the difference in Renters Insurance vs. Rent Guarantor in NYC.
So what does end coverage?
Two things, and the tenant controls neither.
The lease runs out. Coverage lasts for the lease term. If the tenant won't leave when it ends, PandaGuarantee also includes up to 4 months of holdover coverage, so the bond can include unpaid rent while you get the unit back.
The unit becomes legally uninhabitable. This is PandaGuarantee's one exclusion. After a fire or flood that makes an apartment unfit to live in, New York law generally lets the tenant surrender it and stop owing rent. No rent owed means no rent to guarantee. We explain it in Will a Rent Guarantor Actually Pay?
That's the list. A tenant's change of heart isn't on it.
Can a personal guarantor back out?
Usually not by just changing their mind. Signing exposes them to real risks, and a signed guaranty binds them for the lease it covers. But New York courts read guaranties strictly in the guarantor's favor, and that creates several ways out a landlord doesn't see coming.
A renewal may not be covered. In Paganini v. 40 W. 127th St. LLC (2022), a Manhattan appeals court held residential guarantors liable only for the original lease term. The tenants had signed new leases, and the guaranty didn't carry over.
A lease change can release them. Courts have held that a landlord and tenant can't materially change a guaranteed lease without the guarantor's consent. A rent increase or a new term the guarantor never agreed to gives them an argument they're off the hook. Careful landlords get the guarantor to sign off on every renewal.
A holdover may fall outside the guaranty. In one First Department case, a month-to-month tenancy after the lease expired wasn't treated as a renewal, so the guaranty stopped applying.
Life can take them out. A guarantor who files for bankruptcy or dies doesn't cancel anything. But you end up as one creditor among many, chasing a bankruptcy estate or a probate court.
The PandaGuarantee bond doesn't have the holdover or life-event problems. It covers the lease term plus up to 4 months of holdover, and it doesn't depend on any one person's finances.
What should you do at lease signing?
With a rent guarantee:
- Confirm the bond is issued before you hand over keys.
- File the confirmation with the lease, so anyone on your team can find it when rent stops.
- If rent stops, file the claim yourself. You don't need the tenant's cooperation, and approved claims are paid in 3 business days.
With a personal guarantor:
- Use a written guaranty that names renewals, extensions, and holdovers.
- Include a clause where the guarantor waives notice of lease changes and consents to them in advance.
- Have the guarantor sign every renewal anyway. It costs a signature now and closes an argument later.

The protection should outlast the tenant's mood
A guarantee the tenant can switch off isn't a guarantee. PandaGuarantee is built so it can't be. The tenant pays a one-time premium, the bond is free to you, and it stays in force for the lease no matter what the tenant decides in month two.

Frequently asked questions
Can a tenant cancel a rent guarantee after signing the lease?
Not with PandaGuarantee. Once the lease is signed, the tenant can't cancel the bond. It stays in place for the lease term.
Who can file a claim on a rent guarantee bond?
The landlord. The bond's promise runs to you, so you file the claim and receive the payment.
Can a personal guarantor be released from a lease guaranty in New York?
Sometimes. Courts read guaranties strictly, and a guarantor may argue release if the lease was renewed or materially changed without their consent.
Does a personal guaranty cover a holdover tenant?
Not always. In at least one New York case, a month-to-month holdover after the lease expired fell outside the guaranty. PandaGuarantee includes up to 4 months of holdover coverage.
